"We did not know what he was talking about, and I don't think he does either," the homeowner says in his federal complaint. In his civil rights complaint, Francisco Olvera says Sealy Police Sgt. Justin Alderete's charge of "illegal photography" baffled him and several witnesses. Olvera says the trouble started when Alderete responded to a complaint of loud music coming from his home. In front of the home, Alderete asked Olvera to show identification and as Olvera walked into his house to get it, Alderete followed him in. "Olvera did not believe that Alderete had the authority to enter Olvera's residence and, therefore, took a picture of Alderete using his cell phone," the complaint states. Olvera claims that Alderete saw a can of beer on a kitchen counter, next to Olvera's wallet, and immediately handcuffed him. "Olvera was then transported to the City of Sealy jail and charged with 'public intoxication' and 'loud music,'" according to the complaint. Olvera says he was acquitted of all charges in a jury trial. Olvera seeks punitive damages from Alderete, the City of Sealy, and Police Chief John Tollett for trespass, assault, false imprisonment and malicious prosecution. Or that the Second Amendment's provision of free speech applied to all "people", such as billion dollar corporations, so they could spend unlimited amounts of money buying election results. The heck with the law of the land that the people's duly elected representatives in Congress have passed, the conservative Supremes are:"Supreme" (and quite activist, contrary to popular myth). By my count, they are 1 vote short of restoring the pre-Roosevelt Court's interpretation that the Congress and president are mostly powerless to enact national legislation, except in a few limited and enumerated areas. Feinstine, D-CA. and think she has helped the State of California or the United States then I guess you'll agree with this quote by the Senator to FOX NEWS: “ “Sen. Dianne Feinstein, D-Calif., told "Fox News Sunday" that Kagan is "superbly qualified" and "in the mainstream of thinking." ” I just do not think their are very many appointed or elected people that are seated in the Senate or Congress or the Supreme Court that know what the words "in the mainstream of thinking" are or mean. Since Kagan hasn't any prior experience as a judge, we don't really know how she would rule and that is why I posed the question. Heck, the GOP in the state where this story took place wants to ban pornography, oral sex and criminalize gay marriage, and no doubt they want to tell woman what they can do with their bodies too. They already managed to impose their conservative/christian agenda on school text books :banghead: To me, conservatives imposing their "morals" on us is far scarier than liberals wasting our tax money -- Anyhow, this isn't really a right vs left thing, this is more about the police abusing their power. As someone who has been on the wrong side of the law for taking photographs ( I do it for a living) and nearly arrested on multiple occasions, I tend to get passed info about this stuff from my peers and in most cases the charges are trumped up as terrorism or illegal wiretapping issues because the cops don't want to be made to look bad so they try and cover up their blunders. . My comment was surely founded. I don't recall Republicans having a reputation for trampling on human rights. Which ones specifically? Aren't human rights based on morals and morality? What morals do Democrats support? And I must question whether or not they are really morals in the true sense of the word, or the ends simply justifying the means. I think the legions of Republicans out there squashing human rights must have been in some dystopian nightmare you had a while back. Martin, I really had no interest in debating whether or not Kagan is qualified for the position, nor do I care anything about what Feinstein thinks let alone would I use some random senators statement as an indicator of whether or not someone is qualified for the supreme court, my question was put fourth to show that MightyMikes comment was based on no actual fact, just conjecture formed from his personal bias, which he kindly admitted to Do you know what the "mainstream of thinking" is?
